The scares in your attraction are carefully crafted illusions, but the liability is very real.
For the first time, our 2026 Haunt Industry Report asked haunt owners a crucial operational question: Does your haunt use waivers? You all responded, and the results show a major shift in how our industry handles risk.
More than half of all haunted attractions (54.3%) now require waivers in some capacity. Breaking that down, 40.2% of haunts require a waiver for all guests, while 14.1% use them for specific events, attractions, or types of guests. Only 45.7% of haunts are operating entirely without them.
But what is driving this trend? From skyrocketing insurance costs to psychological marketing, here is a look at why the waiver is becoming an essential part of the haunted attraction experience.

Why Are So Many Haunts Using Waivers?
1. A Shield Against Frivolous Injury Claims
When guests are running in the dark, trips and falls happen. Even if your haunt is not legally responsible for an accident, defending against a lawsuit is incredibly expensive. Having guests sign a liability waiver forces them to acknowledge the inherent danger of the activity and often waives their right to sue. A waiver acts as a strong deterrent, designed to frighten injured parties away from pursuing a claim.
Still, it is important to note that waivers are not a bulletproof shield. Under many state laws, a business can still be held legally responsible if they operated negligently, if the conditions were unreasonably dangerous, or if untrained staff behaved recklessly.
2. Appeasing the Insurance Companies
It is no secret that commercial liability insurance rates for the haunt industry have been skyrocketing. To underwrite the unique risks of a haunted attraction, insurers are scrutinizing safety protocols closer than ever. Many insurance carriers are now requiring haunts to use waivers to maintain coverage, or they are offering better premium pricing to those who do. Any opportunity for a haunt owner to get a better deal on insurance is a massive operational win.
3. Establishing Clear Ground Rules & Medical Disclosures
Waivers are highly effective tools for explicitly outlining the rules of admission. They formally state that visitors are banned from running, touching the actors or props, and entering while intoxicated. Furthermore, waivers serve as a documented disclaimer advising people with certain medical conditions, or those with physical limitations, not to enter the attraction. Having a signature on file proves that the guest was warned.
4. The Psychological Scare Tactic (Marketing)
Sometimes, the paperwork is part of the show. A massive waiver can be a brilliant marketing gimmick to hype up the intensity of an attraction. If you want to make guests think your attraction is going to be reallllly intense…an ominously-worded waiver can inspire a sense of dread and anticipation before the guest even steps inside.

The Shift from Paper to Digital
In the past, waivers meant handing guests a clipboard at the door. But paper waivers create massive bottlenecks at the entrance, and storing them physically for years in case a claim arises is an organizational nightmare.
Today, digital smart waivers allow guests to sign documents in advance via email, text message, or directly from a website. This keeps lines moving quickly at check-in and ensures the data is safely stored and easily searchable in the cloud.
